In addition to our universal Terms of Service and Acceptable Use Policy, the following terms apply to Hosting.ph resellers.
Hosting.ph may deny you access to all or part of the service without notice if you engage in any conduct or activities that Hosting.ph, in its sole discretion believes violates any of the terms and conditions in this agreement.
Resellers are only allowed to use the services provided by Hosting.ph for lawful purposes. Hosting.ph strictly prohibits that any provided services are used to promote, distribute, store, process or in any other way handle illegal material and activities. You agree not to maliciously or intentionally interfere with the proper operation of Hosting.ph's systems, including but not limited to defeating identification procedures, obtaining access beyond that which you are authorized for, and impairing the availability, reliability, or quality of service for other customers.
As a reseller, you have the responsibility to monitor the website contents of your client accounts. Any offending materials or activities found or detected within your end users' accounts, in violation of our universal Terms of Service and Acceptable Use Policy should be brought to their attention and proper action carried out by you. Hosting.ph reserves the right to terminate a reseller's client account if found to have repeatedly violating any of our Terms and Acceptable Use Policy if no action has been done by you to rectify the problem.
You agree not to use any part of our website including but not limited to the following:
Reseller accounts and services are set up and activated within 24 hours after payment has been received in full. Account login may be delayed for another 24 hours due to name server propagation of reseller's domain.
Reseller account minimum billing cycle is monthly. Our billing system automatically suspends a reseller's account TEN (10) DAYS after the invoice due date. Suspended accounts will be retained for another THIRTY FIVE (35) DAYS. After such time, and the reseller still fails to settle his/her account, all data and emails under the subscriber's and end user's accounts will be permanently deleted and account closed FORTY FIVE (45) DAYS after the invoice due date. Once an account has been closed/terminated, all web site files including databases, emails, log files, Web Host Manager and cPanel settings can no longer be recovered. Client Portal account, billing history and helpdesk entries will also be deleted from the system. Hosting.ph shall have no liability for deleted files, databases and emails due to account termination.
Hosting.ph will provide support regarding your reseller account setup and server related issues. All other support issues and billing or general inquiries regarding the hosting services you offer to your end users should be handled by you. In cases where a reseller could not handle an end user's technical issue or inquiries, these may be forwarded to our help desk for advice and resolution.
Hosting.ph reserves the right to move end-users from one reseller to another reseller or to Hosting.ph should the customer specifically request it or as the need arises. This may be done without the approval of the losing reseller if the reseller has not responded to several attempts by the end user to request for technical support or inquiries. Hosting.ph may also contact your end users if your reseller account is in suspended status or prior to the termination of your reseller account.
You agree to indemnify, defend, and hold harmless Hosting.ph from any and all liability, penalties, losses, damages, costs, expenses, attorneys' fees, causes of action or claims caused by or resulting indirectly from your use of the service which damages either you, Hosting.ph, or your end user without limitation or exception. This extends to all issues associated with your account, including but not limited to loss of domain name ownership and web site content due to account suspension or termination.
Any contents on this page is subject to change without prior notice. Reseller is responsible for regularly reviewing these Terms of Service. Continued use of Hosting.ph's services following any such changes shall constitute the Reseller's acceptance of such changes.
